Apple posted a new setback in its efforts to block sales of competing tablets of his own product, the iPad. His claim that the Motorola Android tablet Xoom copied the design of the iPad was not retained by the German court in charge of the case and therefore can lead to blockage of the sales of Motorola in Europe.
The court of Düsseldorf considered that the visual features of the Motorola Xoom were sufficiently different from the iPad to avoid confusion between the two shelves. However, at the same time, it denied the motion to consider the Motorola patents submitted by Apple as invalid
Both companies are returned back to back and both will share the cost of the trial (two-thirds for Apple, Motorola for third). After obtaining favorable decisions from the same court in a similar case which concerned the shelves but Samsung's Galaxy Tab (but were quickly bypassed), Apple can not highlight the specifics of its design to prevent the marketing of competing products, even if these features were actually admitted by the court;
But the legal wrangling continues between the two groups from other courses and other aspects of mobile products, always with accusations of patent infringement.
